Know Your Rights in a DUI Stop

Law enforcement officers cannot pull you over for a DUI on a whim. He or she must have valid reason to believe that you are intoxicated, such as seeing you drifting across lane lines, or a tip from another driver. If there was no reason for them to believe that you're driving while intoxicated, then they had no right to pull you over and I can help you fight your DUI charge.

Chemical Tests, Breath Tests & BAC

In order to determine if you are intoxicated, a police officer may have you perform a chemical test such as the Breathalyzer to determine your blood alcohol content (BAC). In Georgia, there is an implied consent law, which means if you are driving on the roads in this state, then you consent to chemical testing; if you refuse to take this test, then you will lose your license.

Your BAC level must be below 0.08% to avoid arrest. If you blow .08 or higher – or if your blood or urine test comes back with a high enough concentration of alcohol in your system – then you will be arrested and your license will be confiscated until your sentence is decided. This is known as a per se offense, because it does not require any further evidence of impairment on the part of the driver in order to make the arrest.
